Patent strengthening is the term that refers to the process of achieving the greatest potential for value from a patent during the prosecution – before a patent is even granted.

Events along the way during patent prosecution create multiple windows of opportunity for a patent, and therefore a portfolio, to be strengthened. Of course, the converse is also true. Patent prosecution provides strategic opportunities, but at the same time merely pushing paper and returning service to a patent examiner without thoughtful consideration can spell disaster.

At a high level, there are four factors to consider:

  • Adoption of the innovation in the marketplace
  • Identifying additional innovations to pursue
  • Tuning applications to a company of interest
  • Abandoning applications with concerns to conserve resources
